Customs

In this part of the CEFTA Web Portal you will find the most important customs import/export procedures separately for each CEFTA Economy. Procedures include but are not limited to: 1.The location of customs clearance offices; 2.The working hours in each office; 3.The procedures to follow based on the destination of your goods; 4.The documents to present to customs authorities for obtaining approval for the relevant destination; 5.The officially approved documents given to you by customs authorities in each case; 6.The procedures followed by customs authorities for calculating the customs value of your goods; 7.The definition of rules of origins determining customs preferential or non preferential tariffs; 8.The Free Trade Agreements signed by each CEFTA Economy with the other signatories. In cases where the final destination of goods is one of the CEFTA Economies, please refer to the import procedures section of this Economy on this portal. In cases where goods transit through different economies before arriving to their final destination, please refer to the transit procedures of these economies. If goods exit one of the CEFTA Economies included in this site, please refer to the export procedures for the relevant Economy.




Laws and regulations

The transit regime is governed by the Kosovo* Customs and Excise Code, respective Article 96 to 102. The Kosovo* Customs and Excise Code (KCEC) and Administrative Instruction for implementation of KCEC that are published in both Albanian and English language on https://dogana.rks-gov.net/en/CUSTOMS-AND-EXCISE-CODE

Documents, certificates, documents used during transit procedure

The circulation/movement of goods from one customs point to another customs point is called transit. The goods transit may be internal transit (when the goods move within the territory of Kosovo*) and international transit.

Movement shall take place: 

a) under the transit procedure; or
b) under cover of a TIR carnet (TIR Convention) provided that such movement: 

- began or is to end outside Kosovo*; or 
- relates to consignments of goods which must be unloaded in Kosovo* and which are conveyed with goods to be unloaded in another country; or  
- is effected between two points in Kosovo* through the territory of another country; under cover of an ATA carnet used as a transit document or  under cover of any document provided for in a Convention, signed by Kosovo* or by post (including parcel post).

The transit procedure shall apply without prejudice to the specific provisions applicable to the movement of goods placed under a customs procedure with economic impact.

The transit procedure shall end and the obligations of the holder shall be met when the goods placed under the procedure and the required documents are produced at the customs office of destination in accordance with the provisions of the procedure in question.

Special conditions for transit procedure

The transit procedure shall apply to goods passing through the territory of another country only if:

a) provision is made to that effect under an international agreement; or
b) carriage through that country is effected under cover of a single transport document drawn up in Kosovo*; in such case the operation of that procedure shall be suspended in the territory of the other country.

The principal shall provide a guarantee in order to ensure payment of any customs debt or other charges which may be incurred in respect of the goods.
The guarantee shall be either:

a) an individual guarantee covering a single transit operation; or
b) a comprehensive guarantee covering a number of transit operations where the principal has been authorized to use such a guarantee by the Customs.

The authorization referred to in paragraph 2 (b) shall be granted only to persons who:

a) are established in Kosovo*;
b) are regular users of transit procedures or who are known to the Customs to have the capacity to fulfill their obligations in relation to these procedures, and
c) have not committed serious or repeated offences against customs or tax laws.

Persons who satisfy the Customs that they meet higher standards of reliability may be authorized to use a comprehensive guarantee for a reduced amount or to have a guarantee waiver. The additional criteria for this authorization shall include:

a) the correct use of the transit procedures during a given period;
b) cooperation with the Customs , and
c) in respect of the guarantee waiver, a good financial standing which is sufficient to fulfill the commitments of the said persons.

The detailed rules for authorizations granted under this paragraph shall be determined in the Administrative Instruction implementing Kosovo* Customs and Excise Code.
 
Except in cases to be determined where necessary in the Administrative Instruction implementing KCEC, no guarantee need be furnished for:

a) journeys by air;
b) carriage by pipeline;
c) operations carried out by the Kosovo* railway company.

The principal shall be the holder of the transit procedure. He shall be responsible for:

a) production of the goods intact at the customs office of destination by the prescribed time limit and with due observance of the measures adopted by the Customs  to ensure identification;
b) observance of the provisions relating to the transit procedure.

Notwithstanding the principal's obligations under paragraph 1, a carrier or recipient of goods who accepts goods knowing that they are moving under transit shall also be responsible for production of the goods intact at the customs office of destination by the prescribed time limit and with due observance of the measures adopted by the Customs  to ensure identification.
The detailed rules for the operation of the procedure and the exemptions shall be determined in the Administrative Instruction implementing this Code.
