I. Public Procurement Agency

Public procurement in the Republic of Moldova is managed by the Public Procurement Agency, a specialized authority under the Ministry of Finance, which ensures implementation and enforcement of state policy on public procurement.

The Agency was created on December 31, 1997, in accordance with Government Decision no.1217 on state public procurement as of December 31, 1997.

Based on Government Decision nr.474 on approval of the Regulation regarding organization, functioning, structure and staff of the Public Procurement Agency as of November 24, 2009, the structure and staff of the Public Procurement Agency consists of 30 persons, including technical maintenance personnel. The management structure consists of the General Director and Deputy General Director; the operating structure is composed of officials, who hold grades of civil servants, and auxiliary personnel.

Public Procurement Agency's mission is regulation, supervision, control and intersectoral coordination in the area of public procurement. In order to achieve its mission, the Agency exercises the following functions:

1. Develops and implements standardized documentation for public procurement procedures;
2. Provides to contracting authorities methodological assistance and counseling in the area of public procurement;
3. Provides training for the staff of contracting authorities involved in the preparation and implementation of the public procurement procedures, as well as for the representatives of suppliers;
4. Publishes “Public Procurement Bulletin”, which is the formal venue for publication of invitations, request for proposals and information on public procurement tenders and awards of public procurement contracts;
5. Manages the webpage www.tender.gov.md;
6. Keeps record of the Automated State Registry of Public Procurement;
7. Examines and registers tender documentation submitted by contracting authorities;
8. Examines reports on public procurement procedures;
9. Examines and registers public procurement contracts concluded as a result of implementing procurement procedures, with the exception of contracts concluded as a result of request for price quotations procedure;
10. Examines and settles disputes between the economies participating in the public procurement procedures;
11. Develops, updates and keeps record of the list of trusted suppliers, as well as the list of banned suppliers;
12. Coordinates foreign assistance activities in the area of public procurement;
13. Performs other activities established by law.

II. Public procurement procedures are regulated in the Republic of Moldova in Chapter 4 of the Law on Public Procurement nr.96 approved on April 13, 2007.

IV. Deadline
Deadlines for submission and receipt of requests for tenders and proposals are set out in Article 26 of the Law of the Republic of Moldova on Public Procurement nr.96 approved on April 13, 2007.

1. Deadlines for submitting and receiving requests to participate and proposals.

The deadline for submission and receipt of requests to participate and proposals will be sufficient to enable economic operators, both local and foreign, to prepare and submit proposals before the closing of the tender procedures.

2. When setting the deadline, contracting authorities shall take into account the complexity of the proposed procurements, the anticipated subcontracting area and the time period necessary for sending the proposals by mail from home and abroad.

3. The contracting authority is responsible for setting the deadline for submitting and receiving requests to participate and proposals.

4. In open and restricted tenders, deadline for submission and receipt of applications and proposals will be at least 15 calendar days from the date of publication of notice, and for public procurement referred to in Article 2 par.(3) – at least 40 calendar days. In case of repeated contracts and in case of an emergency recognized by the contracting authority, the deadline for submission of proposals may be reduced to at least 10 calendar days.

5. In case of application procedures by requesting price offers, the deadline for submission and receipt of proposals will be at least 3 calendar days in case of goods and 10 calendar days in case of works and services, starting with the date of forwarding the invitation. In case of secondary procurements, repeated contracts and in case of emergency recognized by the contracting authority, the deadline for submission of proposals may be reduced to at least 2 days in case of goods and to 5 days in case of services.
